Beta notice. Family Vault is in early beta. This document is a general-purpose draft and has not been reviewed by an attorney. Family Vault should have these Terms reviewed by qualified legal counsel — including for compliance with state-level health-data privacy laws (see Section 6) — before relying on them with real users.
1. Agreement to Terms
These Terms of Service ("Terms") form a binding agreement between you ("you" or "User") and Family Vault ("we," "us," or "our") governing your access to and use of the Family Vault website, application, and related services (collectively, the "Service").
By creating an account, or by otherwise accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of a family, household, or other group, you represent that you have the authority to bind every other person who accesses the Service through that account to these Terms.
2. What the Service Does
Family Vault lets you store information about your family and children — including emergency contacts, allergies, immunization records, insurance information, and medical history — and use that stored information to automatically or semi-automatically fill in third-party PDF forms (e.g., camp, school, or medical forms) that you choose to upload.
The Service is provided as a beta. Features may change, break, be removed, or behave unreliably without notice. You should independently review any auto-filled form for accuracy and completeness before submitting, signing, or relying on it for any purpose — Family Vault is not responsible for errors, omissions, or misplacements in a filled-in form, including those produced by AI-assisted field detection.
3. Eligibility and Accounts
You must be at least 18 years old and have the legal authority (as a parent, legal guardian, or otherwise) to provide any information you enter about a child to use the Service. The Service is intended to be used by adults on behalf of children in their care — it is not directed to, and should not be used directly by, children.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, including activity by anyone you invite to join your family account. Anyone you invite receives full access to all information stored in that family account. Notify us promptly at adam.borelli@gmail.com if you suspect unauthorized access.
4. Sensitive Information You Provide
The Service is specifically designed to store highly sensitive personal information about you and your children, which may include:
- Health, medical, and behavioral history
- Allergy and reaction information
- Immunization and vaccination records
- Health insurance information, including policy numbers
- Contact information for the child and their emergency contacts
- Documents you upload (e.g., immunization records, insurance cards, and other forms), which may themselves contain additional sensitive information
By creating an account and entering this information, you consent to Family Vault collecting, storing, and processing it as described in these Terms and our Privacy Policy, for the purpose of providing the Service to you. You represent that you have the right to provide any information you enter about another person (including a child) and that doing so does not violate any duty of confidentiality you owe to that person or any other party.
5. Not a HIPAA-Covered Entity
Family Vault is not a "covered entity" or "business associate" under the Health Insurance Portability and Accountability Act (HIPAA), and the Service is not HIPAA-compliant. Information you store with us is not subject to the protections, breach-notification timelines, or patient rights that apply to records held by a doctor's office, hospital, insurer, or other HIPAA-covered entity. Do not treat storing information in Family Vault as a substitute for, or equivalent to, keeping it with a HIPAA-covered provider.
6. State Health-Privacy Laws
Some of the information described in Section 4 may qualify as "consumer health data" or similar protected categories under state laws such as Washington's My Health My Data Act and comparable laws in other states, independent of HIPAA. Family Vault's obligations under these laws — including any requirement for a standalone consumer-health-data privacy policy, opt-in consent obtained before (not merely alongside) collection, or specific data-subject rights — are addressed in our Privacy Policy, not fully by these Terms.
7. Your Responsibilities
- Enter accurate information, and keep it up to date — we do not independently verify anything you enter.
- Review any document the Service generates or fills in before relying on, signing, or submitting it.
- Use the Service only for lawful purposes and only to store information you have the right to store.
- Do not attempt to interfere with, reverse-engineer, or gain unauthorized access to the Service or other users' data.
8. Third-Party Processors
We use third-party service providers to operate the Service, which may process your data as our subprocessors — including database and file storage providers and AI providers used to help read uploaded documents and match form fields. We select providers with appropriate safeguards, but we do not control their systems and are not liable for their acts or omissions beyond what applicable law requires.
9. Data Security
We apply security measures, including application-layer encryption for certain sensitive fields, intended to protect your information. No method of storage or transmission is completely secure, and we cannot guarantee the absolute security of your information, particularly during the beta period. You use the Service at your own risk with respect to any security incident outside our reasonable control.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. We do not warrant that auto-filled forms will be accurate, complete, or correctly placed, or that the Service will be available at any particular time, including during the beta period, when downtime, data loss, or resets may occur without notice.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Family Vault AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) $100 USD. Some jurisdictions do not allow certain liability limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold Family Vault harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any right of a third party, including any right of a child whose information you entered.
13. Termination and Data Deletion
You may stop using the Service and request deletion of your account and data at any time by contacting adam.borelli@gmail.com. We may suspend or terminate your access if you violate these Terms, or discontinue the Service (including the beta) at any time. On termination, we will delete or anonymize your data within a reasonable period, except where we are required to retain it by law.
14. Changes to the Service or These Terms
We may modify the Service or these Terms at any time. If we make material changes to these Terms, we will provide notice (for example, by posting an updated version here or notifying you in the app). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles, and any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in California, unless otherwise required by applicable law.
16. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Family Vault regarding the Service.
